We reserve the right to correct genuine pricing or description errors before accepting an order.
If an order cannot be fulfilled, we will contact you and arrange an appropriate refund.
5. Digital Products and Downloads
Digital products may include PDFs, workbooks, templates, guides and organisational frameworks.
Where a product is described as an instant download, access will normally be provided electronically following successful payment and completion of the required checkout process.
Other products may be delivered by email or through an agreed online platform.
The product description will explain the delivery arrangements.
Customers are responsible for providing an accurate email address and ensuring they have suitable software to access the product in the format described.
If you experience difficulty accessing a purchased resource, please contact us.
6. Digital Product Licences
Unless the product description states otherwise, purchasing a digital resource grants a limited, non-exclusive, non-transferable licence to use that resource for its intended purpose.
Individual Purchases
Resources purchased for individual use may be used personally by the purchaser.
They may not be resold, publicly distributed or shared with other purchasers without permission.
Organisational Frameworks
Where an organisation purchases a framework expressly licensed for organisational use, it may use and adapt the resource for its own internal business purposes.
This includes incorporating appropriate content into internal processes, documentation and staff development arrangements.
The licence applies to one purchasing legal entity unless the product description expressly permits wider use.
The organisation may not:
-
Resell the framework or its substantial contents.
-
Distribute the framework to external organisations.
-
Publish the framework as a competing commercial product.
-
Provide it to third parties as a standalone resource for their own independent use.
-
Remove copyright or attribution notices where these are required.
Separate permission is required for external commercial distribution, consultancy resale or multi-organisation licensing.
Third-party resources remain subject to their original owners' licensing conditions.
7. DISC and Behavioural Assessments
DISC assessments and related reports are designed to support self-awareness, communication, relationships, leadership and development.
They are not medical or psychological diagnoses and do not guarantee particular personal or professional outcomes.
Assessment purchases may involve:
1. Purchasing the relevant assessment.
2. Receiving access details or instructions.
3. Completing the assessment through the designated provider.
4. Having the completed report processed and received by Life in the Lead.
5. Receiving the report electronically from Life in the Lead.
The product description or purchase confirmation will explain any applicable delivery timescale.
Customers should complete assessments personally and provide accurate responses.
Assessment reports and associated third-party materials remain subject to applicable copyright and licensing restrictions.
Where assessments are purchased for employees, teenagers or other participants, the purchaser must have appropriate authority to arrange the service and must comply with relevant privacy and participation requirements.
8. Consumer Cancellation Rights
Where you purchase products or services online as a consumer, you may have statutory cancellation rights under applicable UK consumer legislation.
These rights depend on the type of product or service and the circumstances of the purchase.
Digital Content
Consumers generally have a 14-day cancellation period for digital content purchased online.
If you expressly request immediate access to digital content during that period and acknowledge that you will lose your statutory cancellation right once supply begins, that right may be lost when supply starts, provided all legal requirements have been met.
Where those requirements have not been met, your statutory cancellation rights remain unaffected.
Services
For eligible services purchased at a distance, consumers generally have 14 days from contract formation to cancel.
If you expressly request that a service begins during that period and then cancel, you may be required to pay a proportionate amount for services already supplied, where legally permitted.
Where a service has been fully performed, the cancellation right may be lost only where the relevant statutory conditions have been met.
Exercising Cancellation Rights
To cancel an eligible purchase, email Enquiries@lifeinthelead.com with your name, order details and a clear statement that you wish to cancel.
You do not need to use a particular form of words.
Where a refund is due under statutory cancellation rights, it will be processed within the applicable legal timescale, normally using the original payment method.
9. Refunds and Customer Satisfaction
We want customers to feel confident purchasing from Life in the Lead.
If something is not right, we encourage you to contact us so we can understand the issue and work towards a fair resolution.
Digital Products
If you are unhappy with a purchased digital resource, please contact us within 14 days of receiving it, explaining your concern.
We will consider the circumstances and may offer assistance, a corrected or replacement resource, an alternative product or a discretionary refund.
This additional satisfaction process does not create an unconditional refund entitlement where statutory cancellation rights have lawfully ended.
It does not affect your statutory rights where digital content is faulty, not as described or otherwise fails to meet applicable legal requirements.
DISC Assessments
If you experience a technical problem or receive an incorrect or incomplete report, please contact us so that we can investigate.
Where appropriate, we will arrange a correction, replacement, reissue or other remedy.
If you change your mind before assessment access or digital content has been supplied, any applicable statutory cancellation rights will be honoured.
Once assessment content has been supplied, the availability of cancellation and refunds depends on the statutory rules, the nature of the service and any lawful loss of cancellation rights.
Coaching and Training
If you are dissatisfied with a coaching or training service, please contact us promptly.
We will consider the concern fairly and, where appropriate, discuss further support, corrective action, a partial refund or another reasonable resolution.
Your statutory rights to services performed with reasonable care and skill remain unaffected.
10. Coaching Appointments and Rescheduling
For individual coaching and booked development sessions, we ask customers to provide at least 48 hours' notice if they need to reschedule.
Where reasonable notice is given, we will endeavour to arrange an alternative date without an additional rescheduling fee.
Where less than 48 hours' notice is given, or a customer does not attend, we may treat the session as used or apply the cancellation arrangements disclosed at booking, subject to applicable consumer rights and fairness requirements.
We recognise that genuine emergencies happen and will consider exceptional circumstances reasonably.
If Life in the Lead needs to reschedule a session, we will offer an alternative arrangement or an appropriate refund where required.
11. Programmes, Workshops and Events
Specific programmes and events may have additional booking conditions covering attendance, materials, dates, rescheduling and cancellation.
These will be communicated before purchase.
Where an event is cancelled by Life in the Lead, customers will be offered an appropriate remedy, including a refund where legally required.
For programmes involving multiple sessions, the applicable terms will explain what happens if a participant withdraws part-way through.
Statutory consumer rights remain unaffected.
12. Corporate Consultancy and Speaking Engagements
Corporate consultancy, culture diagnostics, commissioned training, executive facilitation, speaking engagements and retainers may be governed by separate written agreements.
These agreements may specify:
-
Scope and deliverables.
-
Fees and payment schedules.
-
Preparation and delivery arrangements.
-
Cancellation and postponement terms.
-
Intellectual property and confidentiality.
-
Data protection responsibilities.
-
Liability and dispute resolution.
Where an applicable separate agreement has been accepted, it will govern the relevant engagement in place of conflicting general website terms.
13. Intellectual Property
Unless otherwise stated, original website content, publications, workbooks, frameworks, training materials and resources created by Life in the Lead are owned by Michelle Claire Smith Ltd or used under licence.
Maxwell Leadership, PeopleKeys and other third-party assessment materials remain subject to their respective intellectual property rights and licence terms.
Purchasing a product does not transfer copyright or ownership.
Customers must not reproduce, resell or distribute protected materials beyond the permissions expressly granted.
14. Responsible Use of Our Resources
Our resources are designed to support understanding, development and informed decision-making.
They do not replace individual legal, medical, psychological, financial or other regulated professional advice.
Organisations using performance management, talent management or employment-related frameworks remain responsible for ensuring that their implementation complies with applicable employment law, equality obligations, data protection requirements and internal policies.
We do not guarantee that a particular resource, assessment or programme will produce a specific outcome.
15. Website Availability
We aim to keep our website and digital services accessible and functioning correctly.
Occasionally, maintenance, technical issues or circumstances beyond our reasonable control may affect availability.
If a purchased product cannot be supplied as agreed, we will provide an appropriate remedy in accordance with applicable law.
16. Liability
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or liability arising under mandatory consumer protection legislation.
Any limitations of liability for bespoke business-to-business services will be addressed in the relevant written agreement.
17. Privacy
We handle personal information in accordance with our Privacy Policy and applicable data protection legislation.
Our Cookie Policy explains how cookies and related technologies are used on our website.
18. Complaints
If you have a concern about a product, purchase or service, please contact us at Enquiries@lifeinthelead.com.
Please provide relevant details so we can investigate and respond appropriately.
We aim to resolve complaints fairly and constructively.
19. Governing Law
These terms are governed by the laws of England and Wales, subject to any mandatory consumer protections and jurisdictional rights that apply.
20. Changes to These Terms
We may update these terms as our products, services or legal obligations change.
The version applicable to an accepted purchase will generally be the version in force when the contract was made, unless a lawful variation is agreed.
